A draft proposal from Sen. Ron Wyden would remove current tax breaks for new data centers and introduce an excise tax on facilities handling AI workloads, aiming to address rising energy costs and community impacts. Public feedback is open through August 31.

 

Sen. Ron Wyden, D-Ore., ranking member of the Senate Finance Committee, has released a draft proposal that would overhaul federal tax policy for data centers, particularly those supporting artificial intelligence. The plan, outlined in a white paper published August 6, calls for eliminating existing tax incentives for new data center construction and imposing a new excise tax on large-scale data centers whose primary function is AI computing.

The proposed excise tax would apply to data centers owned, operated, or leased by major operators, as well as those used by leading technology companies such as Amazon and Meta. According to the draft, the tax would be structured as a gross receipts tax, calculated based on the total revenue generated by the data center's operations. The intent is to target the largest AI hyperscalers and other entities driving the current surge in data center development, while exempting most assets built before 2024 for all but the largest operators.

Tax Revenue Would Help Offset Local Costs

Wyden's proposal comes amid growing concern over the impact of rapid data center expansion on local communities, including higher electricity rates, workforce disruptions, and increased demand on public resources. The new tax is intended to generate revenue to help offset these costs and support workers affected by technological changes. The draft also includes provisions to prevent companies from avoiding the tax by locating data centers in space or outside the United States; if a space-based data center is used by U.S. taxpayers, a withholding tax would apply to those payments.

The proposal is currently in the discussion phase, with Wyden inviting public comments to the Senate Finance Committee's minority staff through August 31. Draft legislative language is expected to be released in the fall. The plan emphasizes that it would not halt data center development or threaten the United States' leadership in AI and technology, but would instead ensure resources are available to assist communities and workers most affected by ongoing changes.

Data Center Growth Is Becoming a Political Flashpoint

Data center construction and its effects on local infrastructure and energy costs have become a prominent political issue, especially as more communities question who should bear the burden of increased utility rates. In March, President Donal Trump announced the Ratepayer Protection Pledge, securing commitments from companies including Amazon, xAI, Oracle, Microsoft, Meta, Google, and OpenAI to absorb utility costs related to their data center operations. Other lawmakers, such as Sen. Bernie Sanders, I-Vt., have called for a moratorium on new data center construction until more is known about the broader impacts of AI and large-scale computing.

Wyden's proposal reflects a broader debate over how to balance technological advancement with the needs of local communities and workers. As the discussion continues, affected stakeholders—including local governments, technology companies, and residents—are encouraged to provide input before the August 31 deadline.

Proposal Faces a Longer Legislative Process

Federal tax policy changes such as those proposed by Wyden typically require committee review, public comment, and legislative drafting before any vote in Congress. If advanced, the new excise tax could reshape incentives for data center development nationwide, with particular impact on regions experiencing rapid growth in AI infrastructure.
